STUDIO SLEW INC. STUDIO SLEW INC. PARTICIPANT TERMS AND CONDITIONS Terms of Service and Code of Conduct for Booked Sessions

Please read these Terms carefully before booking or attending a session.

Welcome to Studio SLEW. These Participant Terms and Conditions (these “Terms”) form a binding agreement between Studio SLEW Inc., a Connecticut nonprofit corporation recognized as a 501(c)(3) tax-exempt organization and authorized to do business in the State of New York, with its principal place of business at 361 Stagg Street, Brooklyn, NY 11206 (“Studio SLEW,” “we,” or “us”), and you, the participant (“you”). By purchasing a ticket, registering for a session, checking the acceptance box during booking, or entering our facility, you knowingly, voluntarily, and unconditionally agree to these Terms.

  1. ELIGIBILITY AND AGE REQUIREMENT By booking or attending, you represent that you are at least eighteen (18) years of age, unless you are attending a permitted session type as a minor under the policy below. We may require valid government-issued photographic identification as a condition of entry to verify age, and we may refuse entry to, or remove, any person who cannot verify eligibility.

Traditional Nude Figure Drawing Sessions (Strictly 18 and Older). Attendance at any nude or semi-nude figure drawing session is restricted to persons who are eighteen (18) years of age or older. No minor is admitted to a nude or semi-nude session. Photographic identification is required for entry.

Costumed, Draped and Themed Sessions (Minors 16 and Older Permitted with Consent). A person who is sixteen (16) or seventeen (17) years of age may attend a fully clothed costumed, draped, or themed session only if all of the following conditions are satisfied: (a) the Studio has given prior written approval of the minor's attendance at the specific session; (b) a parent or legal guardian has completed and signed the Studio's Parent or Guardian Consent, Waiver and Media Release for the minor; and (c) that parent or legal guardian remains physically present and accompanies the minor for the entire session. A minor may not agree to these Terms; the accompanying parent or legal guardian accepts these Terms on the minor's behalf and is responsible for the minor's compliance with them.

  1. CANCELLATION, RESCHEDULING AND REFUNDS As a 501(c)(3) nonprofit, ticket sales directly fund our daily programming, studio equipment, material provisions, and model compensation ledger. To keep our programming accessible and to give waitlisted artists a fair window to claim open easels, the following schedule applies:

Cancellations (Refund Eligibility). You may cancel your session and receive a full digital refund up to forty-eight (48) hours before the scheduled session start time. Cancellations made less than 48 hours before the start time are non-refundable.

Rescheduling. You may change your ticket to any equivalent future session up to twenty-four (24) hours before the session start time using the scheduling link in your booking confirmation email.

Late Window. Within twenty-four (24) hours of a session start time, tickets cannot be rescheduled, transferred, or refunded, except where a refund is required by applicable law.

  1. CAMERA, PHONE AND MEDIA POLICIES BY SESSION TYPE To protect model privacy while providing clear options for working artists, device policies are governed by session format. These policies mirror the protections in our model agreements, and you agree to comply with them as a condition of attendance.

A. Traditional Nude Figure Drawing Sessions (Absolute Zero Tolerance) • Zero-Tolerance Device Policy on Stage. Mobile phones, cameras, recording devices, and wearable camera technology (such as smart glasses) are strictly prohibited while a nude or semi-nude model is on stage for active posing. All phones and cameras must remain completely stowed in bags or placed face-down. • Digital Tablet and iPad Camera Taping. If you draw digitally on a tablet, you must allow staff to apply removable camera-cover stickers over all front and rear cameras before active posing sequences. • No Photography or References. Taking photographs, video recordings, easel time-lapses, or photo references of a nude or semi-nude model is strictly prohibited at all times. No exceptions are granted under any circumstances. • Break Blocks and Artwork Photography. You may use your phone only during designated break blocks when the model is off the stand and properly robed, and only to photograph your own physical or digital artwork or fellow participants in social groups. Cameras and phones must never be pointed toward or capture the model, even when robed.

B. Costumed, Draped and Themed Long-Pose Sessions (Open Collaborative Format) • Baseline Permission. Costumed long-pose sessions permit open media documentation. While the Studio does not require you to record, you are permitted to take photo references, easel time-lapses, and process videos during active posing sequences and break blocks. • Fine Art Ownership and Reproduction Rights. You retain full ownership and copyright of all original drawings, paintings, sculptures, and digital artwork you create during or derived from the session. You may display, exhibit, market, and commercially sell your original artwork, fine-art prints, and artistic reproductions without paying additional reference fees or royalties to the model or the Studio. • Monetized Process and Vlog Usage. You may include video footage, easel time-lapses, or photo references captured during costumed sessions in your personal vlogs, process videos, online portfolios, social media posts, or educational content, including content that generates ad revenue (for example, YouTube monetization or creator funds) or incorporates brand sponsorships. • Strict Prohibition on Raw Photo-Reference Sales. You are strictly forbidden from selling, licensing, distributing, or commercially exploiting raw digital photographs or video files of the model. Photo references captured during costumed sessions are granted solely as tools for completing fine artwork and documenting your personal creative process. • Social Media Credits and Tagging. When sharing artwork, process videos, or photo references captured during costumed sessions online, you are expected to respect and credit the model by tagging the model's official Instagram handle whenever it is provided on the studio whiteboard.

  1. SPACE DECORUM, SAFETY AND STAFF COMPLIANCE Authority of Session Leads. Every session is governed by a designated Studio Session Leader. You agree to comply promptly with all logistical and structural directions given by studio staff.

Zero-Tolerance Misconduct. Studio SLEW maintains strict professional boundaries. Inappropriate personal comments, physical contact, unapproved approaches toward the model stage, or disruptive behavior toward staff or fellow artists will result in immediate ejection. Staff retains the right to terminate a booking in real time and to require immediate departure without a refund.

  1. STUDIO SECURITY AND SURVEILLANCE To ensure the safety of our community, staff, and models, Studio SLEW uses video surveillance in common studio areas (including entrances and lobby spaces). By entering the facility, you consent to security monitoring. Consistent with New York law, cameras are strictly prohibited from monitoring private changing areas, restrooms, or the model posing stage. Surveillance footage is retained solely for asset protection and security and is deleted within thirty (30) days absent an active security incident.

  2. ASSUMPTION OF ORDINARY RISK; LIMITED WAIVER Fine-art environments involve raw media such as charcoal, oil paint, solvents, and fixatives. You understand and voluntarily assume the ordinary risks of participating in a working art studio. To the fullest extent permitted by law, you agree that Studio SLEW is not liable for stained clothing, personal property damage, or ordinary operational accidents not caused by our negligence.

Your Indemnity. To the fullest extent permitted by law, you agree to indemnify and hold harmless Studio SLEW, and its officers, staff, session leaders, and models, from any claim, loss, or expense (including reasonable attorneys' fees) arising from your own violation of these Terms, your negligent or intentional acts, or your unauthorized capture, use, sale, or distribution of any image or recording of a model.

Savings Clause. Nothing in these Terms waives, releases, or limits any liability that may not be waived or released under New York law. Without limiting the foregoing, you acknowledge that New York General Obligations Law Section 5-326 may render unenforceable any agreement that exempts an owner or operator of a place of amusement or recreation from liability for its own negligence toward a user who has paid a fee, and nothing here purports to release Studio SLEW from liability for its own negligence, gross negligence, recklessness, or intentional misconduct where such release is prohibited by law.

  1. THIRD-PARTY CONDUCT Studio SLEW establishes and enforces strict studio rules to protect model privacy and community safety and will permanently ban any participant who violates them within our facility. Participants nonetheless act as independent individuals. Studio SLEW is not liable for the unauthorized, intentional, or unlawful acts of third-party participants that occur outside studio premises or in violation of these Terms, and Studio SLEW is not obligated to pursue legal action against a violating participant on your behalf.

  2. ACCOMMODATIONS We operate as an inclusive, supportive environment. If you require seating or easel-layout adjustments due to a physical limitation, please notify the Session Leader before poses begin.

  3. ACCOUNT REVOCATION AND BANNING Studio SLEW reserves the right to cancel future bookings, revoke electronic portal profiles, and permanently ban any individual who violates these Terms or compromises the safety, privacy, or focus of our community, without refund.

  4. DATA PRIVACY We handle your booking, contact, and payment information consistent with the New York SHIELD Act (General Business Law § 899-bb) and use it solely to administer your booking, process payment, verify eligibility, and communicate with you about sessions. We maintain reasonable administrative, technical, and physical safeguards and do not sell your personal information.

  5. CHANGES TO THESE TERMS We may update these Terms from time to time. The version in effect at the time you book or attend a session governs that session. Material changes will be posted on our website and reflected in the booking flow. Your continued booking or attendance after a change constitutes acceptance of the updated Terms.

  6. GOVERNING LAW, VENUE AND DISPUTE RESOLUTION These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your attendance shall be brought exclusively in the state or federal courts located in Kings County (Brooklyn), New York, and you consent to the personal jurisdiction of those courts. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

  7. ELECTRONIC ACCEPTANCE AND ENTIRE AGREEMENT By checking the acceptance box during booking, completing a ticket purchase, or entering the facility, you agree to these Terms, and your electronic acceptance is valid and enforceable under the New York Electronic Signatures and Records Act and the federal E-SIGN Act. These Terms, together with any session-specific rules posted at the time of booking, constitute the entire agreement between you and Studio SLEW regarding your participation and supersede any prior understanding on that subject.
